CaptivateIQ Event Terms and Conditions

These Terms and Conditions (“Terms”) apply to your registration for and participation at any CaptivateIQ event (the “Event”) and are a legally binding agreement between you and the applicable CaptivateIQ entity hosting the Event (“CaptivateIQ”).

The Event

Registration

You may only register for and attend the Event in accordance with these Terms. To register, you must complete the registration process and pay any applicable fee. Registration is subject to availability and may close earlier than posted deadlines. CaptivateIQ may change the Event program at any time. You must be at least 21 years of age on the first day of the Event.

Code of Conduct

During your attendance, you must comply with the CaptivateIQ Code of Conduct at all times.

Safety and Security

Entry to Event

You and your property may be subject to reasonable search upon entry. Refusal may result in denied entry.

Departure From Event

Event representatives may ask you to leave if your behavior raises safety or security concerns.

Refunds

If you are denied entry or removed from the Event, no refund will be issued.

Your Information

CaptivateIQ will handle your information in accordance with its Privacy Policy. Your contact information may be shared with Event Sponsors if you attend sponsor-related sessions or opt in to communications.

By participating, you agree that CaptivateIQ may capture and use recordings of your voice and image in accordance with the Privacy Policy.

Recordings and Your Materials

You grant CaptivateIQ a perpetual, worldwide, royalty-free license to use, reproduce, modify, and distribute recordings and materials you provide. You waive any moral rights to the extent permitted by law.

You represent that your materials are accurate, you have the rights to share them, and they do not violate any intellectual property rights.

Taxes

Each party is responsible for paying applicable taxes and governmental fees.

Cancellation

By You

Cancellation policies and refund instructions will be listed on the Event registration website.

By CaptivateIQ

CaptivateIQ may cancel the Event or your registration at any time. If canceled and you are compliant, a refund will be issued per the Event policy.

Effect of Cancellation

Certain sections will survive cancellation, including Your Information, Recordings, Taxes, Feedback, Liability, and others.

Trade Compliance

You represent that you are not subject to sanctions or listed as a restricted party.

Feedback

Any feedback you provide may be used freely by CaptivateIQ without obligation.

Assumption of Risk

Participation is voluntary, and you assume all risks associated with attending the Event.

Release of Claims

You release CaptivateIQ and related parties from any claims arising from the Event, recordings, or your materials.

Limitation of Liability

CaptivateIQ will not be liable for indirect or consequential damages. Liability is limited to the amount of fees paid for the Event.

Governing Law and Dispute Resolution

These Terms are governed by California law. Disputes will be resolved through binding arbitration administered by the American Arbitration Association in Oakland, California.

Miscellaneous

Modifications: Terms may be updated at any time.
Assignment: Assignment requires written approval, except in certain cases.
No Agency: No partnership or joint venture is created.
Severability: Invalid provisions do not affect the remainder.
Force Majeure: No liability for events beyond reasonable control.
Entire Agreement: These Terms represent the full agreement.

Definitions

Affiliate: Entity under common control.
Claims: Third-party claims or demands.
Control: Ownership of more than 50% voting rights.
Dispute: Any controversy related to these Terms.
Event Sponsor: Third-party sponsor.
Feedback: Suggestions or recommendations.
Privacy Policy: CaptivateIQ’s Privacy Notice.
Recordings: Audio/visual capture of participants.
Your Materials: Materials submitted or presented by you.
